By participating in the Angie’s List™ 2017 "Work with the Best" Sweepstakes (the "Promotion"), each Entrant ("Entrant") unconditionally accepts and agrees to comply with, and abide by these Official Rules and the decisions of Angie’s List, Inc. (the "Sponsor") and US Sweepstakes & Fulfillment Co. (the "Sweepstakes Administrator"), which shall be final and binding in all respects.
ELIGIBILITY: The Promotion is not open to the general public and is restricted to trade. The Promotion is only open to business owners of professional services within Angie’s List approved industry categories*, who are legal residents of the 48 contiguous United States, including the District of Columbia, and are age 18 or older at the time of entry. Void in Alaska, Hawaii, Puerto Rico, Guam, the U.S. Virgin Islands, outside the U.S., and wherever else prohibited by law. PROMOTION DESCRIPTION & ENTRY PERIODS: The Promotion begins at 12:00:00 AM Eastern Time ("ET") on Thursday, January 5, 2017 and ends at 11:59:59 PM ET on Sunday, December 31, 2017 (the "Promotion Period"). The Promotion has two components: A Grand Prize Sweepstakes (the "Grand Prize Sweepstakes") and a Quarterly Prize Sweepstakes (the "Quarterly Sweepstakes").
The Grand Prize Sweepstakes will include one (1) Grand Prize Drawing from among all eligible entries received during the Promotion Period.
The Quarterly Sweepstakes will include four (4) quarterly entry periods (each, a "Quarterly Entry Period") and four (4) corresponding quarterly random drawings (each, a "Quarterly Drawing") as defined in the "Quarterly Entry Period & Quarterly Drawing Schedule" below. Entries must be received during a Quarterly Entry Period indicated in the chart below to be eligible for that Quarterly Entry Period’s Drawing and prize. Non-winning entries will roll over to subsequent Quarterly Entry Periods.
HOW TO ENTER: To enter both the Grand Prize Sweepstakes and the Quarterly Sweepstakes, visit http://b2b.angieslist.com/WWTB201 and follow all entry instructions to complete the entry form, including your full name, business name, business mailing address, phone number, email address and industry category, and submit (the "Entry"). Entries must be received between Thursday, January 5, 2017 at 12:00:00 AM ET and Sunday, December 31, 2017 at 11:59:59 PM ET. Entrants are subject to all notices posted online including but not limited to the Sponsor’s Privacy Policy, which can be found at https://www.angieslist.com/privacypolicy.htm.
Limit: One (1) Entry per person regardless of whether entrant has more than one email address. All entries become the property of the Sponsor and will not be acknowledged or returned.
PRIZES/APPROXIMATE RETAIL VALUE ("ARV")/ODDS: There is one (1) Grand Prize and four (4) Quarterly Prizes available to be won.
Quarterly Prizes: Four (4) Quarterly Prize winners will each receive a prize package to include DEWALT Tools of winner’s choice, up to $3,500 in value. Quarterly Prize winners will have the opportunity to select tools specific to their needs, not to exceed $3,500. The Sponsor, in its sole discretion, will determine the value of the tools selected. The maximum ARV of each Quarterly Prize is $3,500. There is a limit of one (1) Quarterly Prize per person. Odds of winning a Quarterly Prize will depend upon the total number of eligible entries received during each Quarterly Entry Period. Each Quarterly Prize package will be awarded within approximately 60 days after the winner is verified.
Grand Prize: One (1) Grand Prize winner will receive a 2018 Truck. The ARV of the Grand Prize is: $45,000. ARV is as of date of drafting these Official Rules. The difference in value of the Grand Prize as stated herein and value at time of prize notification/award, if any, will not be awarded. The odds of winning the Grand Prize will depend upon the total number of eligible entries received during the Promotion Period. The Grand Prize will be awarded within approximately 60 days after the winner is verified.
Grand Prize winner must take delivery of the 2018 Truck (the "Vehicle") from the automotive dealership designated by the Sponsor. The Sponsor will use best efforts; however, to select a dealership that is close to the Grand Prize winner’s residence. Grand Prize winner must be a licensed driver and have the ability to acquire auto insurance and will be required to provide proof of auto insurance at time of delivery. Failure to meet license and insurance requirements will result in disqualification and an alternate winner may be randomly selected. Vehicle will be available with standard equipment, as designated by the Sponsor; any upgrades and options are at the sole expense of the Grand Prize winner. Color, package, factory options, and other prize specifics to be determined by Sponsor in its sole discretion and are subject to availability. The Sponsor reserves the right, in its sole discretion, to require the Grand Prize winner to select the Vehicle from available dealer stock. Grand Prize winner shall bear all risk of loss or damage to the Vehicle after it has been delivered to the specified Delivery Site. Grand Prize winner will be responsible for any and all costs associated with the collection and use of the Vehicle, including but not limited to, optional equipment, freight and dealer prep, title, license, insurance, registration fees, applicable taxes and any travel and transportation costs associated with collecting the Vehicle and for compliance with all applicable laws associated herewith. All other costs not specifically stated herein are the responsibility of the Grand Prize winner. Grand Prize winner must personally retrieve the Vehicle within 30 days of written notification of delivery. Sponsor reserves the right to extend the delivery date of vehicle by up to six (6) months from the date of notification to the Grand Prize winner. Vehicle will only be released upon proof of valid driver's license currently in force and satisfactory proof of insurance. Accessories and options may vary: interior/exterior color (subject to availability). Accessories are subject to change without notice. Grand Prize winner is not eligible for any cash back, incentives or rebates which may be available on the Vehicle at time of delivery. All prize details are at the sole discretion of the Sponsor.
The total ARV of all prizes available to be won: $59,000.
RANDOM DRAWINGS, WINNER NOTIFICATIONS & WINNER VERIFICATION:
Quarterly Drawings & Winner Notifications: The Quarterly Prize winners will be selected in a series of Quarterly Drawings on or about the Quarterly Drawing Dates indicated in the Quarterly Entry Period & Quarterly Drawing Schedule above. Each Quarterly Prize winner will be selected from among all eligible Entries received within each Quarterly Drawing Period. Quarterly Drawings will be conducted by the Sweepstakes Administrator, whose decisions are final.
Each potential Quarterly Prize winner will be notified via email and/or phone, and will be required to sign and return, within five (5) days of notification, an Affidavit of Eligibility, a Liability Waiver, an IRS W-9 Form and where allowable, a Publicity Release (collectively, "the Releases"). These Releases will require each potential Quarterly Prize winner to furnish his/her Social Security Number for the purpose of tax reporting, as required by law, and for the purpose of a background check. Noncompliance will result in disqualification and an alternate winner may be selected. Each Quarterly Prize winner will also be required to submit to a background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Promotion or Sponsor, as determined by Sponsor in its sole discretion. Sponsor reserves the right to disqualify a potential Quarterly Prize winner on the basis of the findings resulting from such background check or if a potential Quarterly Prize winner fails to properly authorize and/or provide the required information in connection with such background check.
Grand Prize Drawing & Winner Notification: The Grand Prize winner will be selected in a random drawing on or about Monday, January 8, 2018 from among all eligible entries received during the Promotion Period by the Sweepstakes Administrator. If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian who will be required to execute and return the Releases on minor’s behalf.
PRIZE CONDITIONS:
Winners will be required to consent and agree to be photographed by a photographer appointed by the Sponsor after receipt of his/her prize. Winner agrees to assist the Sponsor in coordination and scheduling of the date for photographs to be shot.
If a prize notification or prize is returned as undeliverable, or if winner is found to be ineligible or not in compliance with these Official Rules that winner will be disqualified, and the prize may be awarded to an alternate winner in a separate random drawing. Only two (2) alternate winners may be determined through this process, after which the prize will remain un-awarded.
Prizes are not redeemable for cash. Prizes are not assignable nor transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. No cash in lieu of prizes and no exchange or substitution of prizes, except at the sole discretion of the Sponsor. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility.
Winners are responsible for all federal, state, local and income taxes associated with winning prize. Winners will be required to furnish his/her Social Security Number for the purpose of preparation of tax forms as required by law.
Prizes are awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. Winners acknowledge that the Sponsor and all other businesses affiliated with this Promotion and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the prize being offered, except that each merchandise prize shall be subject to its manufacturer’s standard warranty (if any).
PUBLICITY: Except where prohibited by law, entry and acceptance of prize constitute permission to use winner's name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.
GENERAL: Although subsequent attempts to enter may be received, only the first complete entry received from a particular entrant will be eligible; subsequent attempts by the same person to enter, including entries submitted with an alternate email address, will be disqualified.
Participating Entrants agree to these Official Rules and the decisions of the Sponsor and the Sweepstakes Administrator, and release the Sponsor, the Sweepstakes Administrator, DEWALT and their affiliated companies, and all other businesses involved in this Promotion, as well as the employees, officers, directors and agents of each (the "Released Parties"), from all claims and liability relating to their participation in the promotion, and the acceptance and use/misuse of the prize offered. Winners assume all liability for any injury or damage caused or claimed to be caused, by participation in this Promotion or use/misuse or redemption of the prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Promotion or in the announcement of the prize.
In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any entrant or potential winner to provide Sponsor with proof that such party is the authorized account holder of the email address associated with the entry. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Promotion. By participating in the Promotion, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the Sweepstakes Administrator, which are final and binding in all matters relating to the Promotion. Failure to comply with these official rules may result in disqualification from the Promotion. Sponsor reserves the right to: (i) permanently disqualify from any Promotion it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw a method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Promotion). If for any reason this Promotion is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion, at which time, Sponsor will conduct a random drawing from among all eligible entries received at the time of the Promotion termination.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE PROMOTION, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Indiana. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the state of Indiana without giving effect to any choice of law or conflict of law rules (whether of the State of Indiana or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Indiana. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.

The potential Grand Prize winner will be notified via email and/or phone, and will be required to sign and return, within five (5) days of notification, an Affidavit of Eligibility, a Liability Waiver, an IRS W-9 Form and where allowable, a Publicity Release (collectively, "the Releases"). These Releases will require the potential Grand Prize winner to furnish his/her Social Security Number for the purpose of tax reporting, as required by law, and for the purpose of a background check. Noncompliance will result in disqualification and an alternate winner may be selected. The Grand Prize winner will also be required to submit to a background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Promotion or Sponsor, as determined by Sponsor in its sole discretion. Sponsor reserves the right to disqualify the potential Grand Prize winner on the basis of the findings resulting from such background check or if the potential Grand Prize winner fails to properly authorize and/or provide the required information in connection with such background check.
If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian who will be required to execute and return the Releases on minor’s behalf.
PRIZE CONDITIONS:
Winners will be required to consent and agree to be photographed by a photographer appointed by the Sponsor after receipt of his/her prize. Winner agrees to assist the Sponsor in coordination and scheduling of the date for photographs to be shot.
If a prize notification or prize is returned as undeliverable, or if winner is found to be ineligible or not in compliance with these Official Rules that winner will be disqualified, and the prize may be awarded to an alternate winner in a separate random drawing. Only two (2) alternate winners may be determined through this process, after which the prize will remain un-awarded.
Prizes are not redeemable for cash. Prizes are not assignable nor transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. No cash in lieu of prizes and no exchange or substitution of prizes, except at the sole discretion of the Sponsor. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility.
Winners are responsible for all federal, state, local and income taxes associated with winning prize. Winners will be required to furnish his/her Social Security Number for the purpose of preparation of tax forms as required by law.
Prizes are awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. Winners acknowledge that the Sponsor and all other businesses affiliated with this Promotion and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the prize being offered, except that each merchandise prize shall be subject to its manufacturer’s standard warranty (if any).
PUBLICITY: Except where prohibited by law, entry and acceptance of prize constitute permission to use winner's name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.
GENERAL: Although subsequent attempts to enter may be received, only the first complete entry received from a particular entrant will be eligible; subsequent attempts by the same person to enter, including entries submitted with an alternate email address, will be disqualified.
Participating Entrants agree to these Official Rules and the decisions of the Sponsor and the Sweepstakes Administrator, and release the Sponsor, the Sweepstakes Administrator, DEWALT and their affiliated companies, and all other businesses involved in this Promotion, as well as the employees, officers, directors and agents of each (the "Released Parties"), from all claims and liability relating to their participation in the promotion, and the acceptance and use/misuse of the prize offered. Winners assume all liability for any injury or damage caused or claimed to be caused, by participation in this Promotion or use/misuse or redemption of the prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Promotion or in the announcement of the prize.
In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any entrant or potential winner to provide Sponsor with proof that such party is the authorized account holder of the email address associated with the entry. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Promotion. By participating in the Promotion, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the Sweepstakes Administrator, which are final and binding in all matters relating to the Promotion. Failure to comply with these official rules may result in disqualification from the Promotion. Sponsor reserves the right to: (i) permanently disqualify from any Promotion it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw a method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Promotion). If for any reason this Promotion is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion, at which time, Sponsor will conduct a random drawing from among all eligible entries received at the time of the Promotion termination.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE PROMOTION, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Indiana. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the state of Indiana without giving effect to any choice of law or conflict of law rules (whether of the State of Indiana or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Indiana. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
